Terms and Conditions

This document is a public offer (adhesion contract) for the provision of digital consulting services by FOP Gorkusha Mykhailo Yuriyovych (hereinafter - the "Provider"). The terms of the offer are the same for all customers and cannot be changed for an individual consumer. By accepting the terms of this offer (by placing an order and paying for services on the website), the client (hereinafter - the "Customer") enters into an electronic service agreement with the Provider under the terms set forth below.
1Terms and Definitions
Provider – Individual Entrepreneur Gorkusha Mykhailo Yuriyovych, who provides consulting and other digital services under the terms of this public contract.
Customer – any legally capable individual (aged 18 or older) or representative of a legal entity who has accepted this public offer by paying for the Provider's services.
Services – digital consulting services provided by the Provider remotely (online). Services include: educational and informational events (webinars, online training, workshops), individual consultations, software configuration services, corporate cloud service support, and assistance in purchasing software licenses.
Electronic Contract – an agreement between the Provider and the Customer concluded by accepting this public offer in accordance with the Law on Electronic Commerce.
2Types and Description of Services
Educational Events: online webinars, masterclasses, trainings and other educational activities. Topics and schedules are published on the website.
Individual Consultations: personalized consultations on cloud service implementation, software configuration, digital business transformation, etc. Consultation duration is determined by the selected service type.
IT Support and Software Configuration: implementation and technical configuration of software, including Microsoft 365, Google Workspace, and other cloud services.
Corporate Service Support: long-term consulting support for the Customer's IT infrastructure.
License Provision: assistance in purchasing licenses for paid online services and software.
3Order and Service Delivery Process
To order services, the Customer selects the desired service on the website and places an electronic order. When ordering, the Customer provides accurate information: full name, contact email, phone number.
Successful online payment constitutes acceptance of the offer. The contract is considered concluded upon the Provider receiving payment confirmation.
After payment, the Provider contacts the Customer within 1 business day to coordinate service delivery details.
All services are provided remotely in electronic form via video conferencing or other online tools.
4Payment and Pricing
All service prices are listed in Ukrainian hryvnia (UAH). Prices include all applicable taxes and fees.
Payment is made by bank card through the WayForPay payment service with Apple Pay and Google Pay support.
Services are provided on a 100% prepayment basis. Orders are cancelled if payment is not received within 24 hours.
After a successful transaction, the Customer receives electronic payment confirmation via email.
5Service Delivery Method
Since all services are digital, delivery is exclusively in electronic form via the internet: video conference links, access to educational materials, electronic documents, etc.
No physical delivery of goods is performed.
Services can be provided to Customers from any location or country with internet access.
6Rights and Obligations of Parties
The Provider undertakes to:
• Provide quality services within agreed timeframes
• Ensure confidentiality of Customer data
• Provide support regarding rendered services
The Customer undertakes to:
• Provide accurate information when placing an order
• Pay for services in a timely manner
• Cooperate with the Provider for proper service delivery
• Not distribute received materials without Provider's permission
7Refund Policy
General principle: after full service delivery, payment is non-refundable.
Cancellation 24+ hours before start: full refund or credit to balance for future services.
Cancellation less than 24 hours before: up to 50% of payment may be retained as compensation for preparation costs.
Refund alternatives:
• Credit to account balance
• Rescheduling session to another date
• Exchange for equivalent service of different format
For refunds, send a request to email c@gorkusha.name with subject "Refund Request". Processing takes up to 14 days.
8Limitation of Liability
The Provider's maximum liability for any damages is limited to the amount actually paid by the Customer for the respective service.
The Provider is not liable for:
• Results of applying recommendations provided during consultations
• Technical issues on the Customer's side
• Indirect, incidental, or consequential damages
• Data loss due to Customer's fault
Consulting services are informational in nature. Final decisions and their consequences remain the Customer's responsibility.
9Intellectual Property
All materials provided by the Provider (presentations, documents, video recordings, templates, etc.) are intellectual property and protected by copyright.
The Customer receives a limited, non-exclusive license to use materials for personal or internal organizational needs.
Prohibited:
• Publishing materials publicly
• Transferring to third parties
• Commercial use without Provider's written consent
10Force Majeure
Parties are released from liability for non-fulfillment of obligations if caused by force majeure circumstances: natural disasters, war, large-scale cyberattacks, government decisions that make contract execution impossible.
The party invoking force majeure must notify the other party within 3 days of such circumstances occurring.
If force majeure continues for more than 30 days, either party may terminate the contract with appropriate fund recalculation.
11Dispute Resolution
All disputes are resolved through negotiations. To file a complaint, the Customer contacts email c@gorkusha.name.
The Provider reviews the complaint within 14 days of receipt and provides a written response.
If agreement cannot be reached, the dispute is submitted to court at the Provider's location in accordance with Ukrainian law.
12Changes to Terms
The Provider reserves the right to make changes to these Terms unilaterally.
The updated version is published on the website with the update date indicated.
Continued use of services after publication of changes constitutes Customer's agreement to the new Terms.
Orders placed before changes are made are subject to the Terms in effect at the time of ordering.
